1. Introduction and Acceptance

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Resident," "You," or "Your") and Satori Homes ("We," "Us," or "Our") regarding your use of our property rental services and website. By accessing our website, making inquiries, booking properties, or entering into rental agreements with us, you acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree with any part of these Terms, you must not use our services or rent our properties. These Terms should be read in conjunction with our Privacy Policy and Cookie Policy.

2. Definitions

For the purposes of these Terms:

  • "Service" refers to our property rental services, website, and all associated offerings
  • "Property" or "Properties" refers to residential accommodations available for rent through Satori Homes
  • "Rental Agreement" refers to the specific contract governing a property rental
  • "Booking" refers to a confirmed reservation for a property
  • "Website" refers to our online platform accessible at satoriolesa

3. Eligibility and Capacity

You must be at least 18 years of age and possess the legal capacity to enter into binding contracts under Thai law. By using our services, you represent and warrant that you meet these requirements. If you are entering into a rental agreement on behalf of an organization or group, you represent that you have the authority to bind that entity to these Terms.

4. Service Description

Satori Homes provides property rental services in Bangkok, Thailand. Our services include:

  • Property listings and information
  • Booking and reservation management
  • Property maintenance and support during your stay
  • Customer service and inquiry assistance

Property availability is subject to change without prior notice. We strive to maintain accurate property information but cannot guarantee availability until a booking is confirmed. All property descriptions, photographs, and amenity listings are provided in good faith but may be subject to minor variations.

5. Booking and Reservation Process

5.1 Inquiry and Viewing

You may submit inquiries about properties through our website or by contacting us directly. We will respond to inquiries within a reasonable timeframe, typically within 4-24 hours. Property viewings can be arranged subject to availability and scheduling.

5.2 Booking Confirmation

A booking becomes confirmed only upon our written confirmation (via email or signed agreement) and receipt of the required deposit. Until confirmation, property availability is not guaranteed. We reserve the right to decline bookings at our discretion.

5.3 Rental Agreement

Upon booking confirmation, you will receive a detailed Rental Agreement outlining specific terms for your stay, including dates, pricing, deposit requirements, house rules, and any property-specific conditions. This Rental Agreement supplements these general Terms and Conditions.

6. Payment Terms

6.1 Pricing and Currency

All prices are quoted in Thai Baht (฿) unless otherwise specified. Rates include utilities, basic amenities, and regular maintenance as outlined in your Rental Agreement. Additional services or extended stays may incur supplementary charges.

6.2 Deposit Requirements

A deposit is required to secure your booking. Deposit amounts vary by property and rental duration, typically ranging from 30-50% of the total rental cost. The deposit is applied toward your total rental fee.

6.3 Payment Schedule

Unless otherwise agreed, the remaining balance is due before your arrival date. For extended stays exceeding 30 days, monthly payment arrangements may be available. Payment methods accepted include bank transfer, credit card, and other methods as specified in your Rental Agreement.

6.4 Security Deposit

A refundable security deposit is required for damage protection. This amount is separate from the booking deposit and will be refunded within 14 days after your departure, subject to property inspection and deduction of any damages or outstanding charges.

7. Cancellation and Refund Policy

7.1 Cancellation by Resident

Cancellation terms depend on timing and property type:

  • More than 30 days before arrival: Full refund minus 10% administrative fee
  • 15-30 days before arrival: 50% refund of total rental cost
  • Less than 15 days before arrival: No refund; option for future credit (valid 12 months)

Specific properties may have different cancellation terms as stated in your Rental Agreement. All cancellations must be submitted in writing via email.

7.2 Cancellation by Satori Homes

We reserve the right to cancel bookings due to property unavailability, force majeure events, or other circumstances beyond our control. In such cases, we will provide full refund of all payments made or offer alternative properties of comparable quality. We are not liable for consequential damages resulting from our cancellation.

8. Resident Responsibilities and Conduct

8.1 Property Use

You agree to:

  • Use the property for residential purposes only
  • Maintain the property in good condition
  • Respect property rules and neighborhood guidelines
  • Comply with maximum occupancy limits
  • Report damage or maintenance issues promptly
  • Allow access for scheduled maintenance or emergency repairs

8.2 Prohibited Activities

The following activities are strictly prohibited:

  • Illegal activities or violations of Thai law
  • Subletting or unauthorized guests beyond agreed occupancy
  • Smoking in non-designated areas (where applicable)
  • Excessive noise or disturbances to neighbors
  • Damage to property or furnishings
  • Unauthorized alterations to the property
  • Commercial activities without prior written consent

8.3 Liability for Damages

You are responsible for any damage to the property beyond normal wear and tear. Repair or replacement costs will be deducted from your security deposit. Damages exceeding the security deposit amount remain your responsibility and must be paid within 14 days of notification.

9. Intellectual Property Rights

All content on our website, including text, graphics, logos, images, and software, is the property of Satori Homes or its content suppliers and is protected by Thai and international copyright laws. You may not reproduce, distribute, modify, or create derivative works from our content without express written permission.

You are granted a limited, non-exclusive, non-transferable license to access and use our website for personal, non-commercial purposes related to property rental inquiries and bookings.

10. Disclaimers and Warranties

While we strive to provide accurate information and well-maintained properties, our services are provided "as is" without warranties of any kind, express or implied. We do not guarantee:

  • Uninterrupted or error-free service
  • That properties will meet all your specific requirements
  • Complete accuracy of property descriptions or photographs
  • Freedom from technical issues or system failures

We are not responsible for third-party services, products, or content accessed through our website. Any reliance on such third-party offerings is at your own risk.

11. Limitation of Liability

To the maximum extent permitted by Thai law, Satori Homes shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or other intangible losses resulting from:

  • Your use or inability to use our services
  • Unauthorized access to or alteration of your data
  • Third-party conduct or content on our website
  • Property unavailability or service interruptions

Our total liability for any claims related to our services shall not exceed the amount you paid for the specific property rental in question.

12. Indemnification

You agree to indemnify, defend, and hold harmless Satori Homes, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of our services, violation of these Terms, or infringement of any third-party rights.

13. Force Majeure

Neither party shall be liable for failure to perform obligations due to circumstances beyond reasonable control, including but not limited to natural disasters, war, terrorism, government actions, labor disputes, utility failures, or pandemics. In such events, obligations are suspended for the duration of the circumstance, and we will work with you to find reasonable alternative arrangements.

14. Termination

We reserve the right to terminate or suspend your access to our services immediately, without prior notice, if you violate these Terms or engage in conduct that we determine to be harmful to our business, other residents, or property owners.

Upon termination, your right to use our services ceases immediately. Provisions of these Terms that by their nature should survive termination shall remain in effect, including provisions regarding intellectual property, disclaimers, indemnification, and limitations of liability.

15. Dispute Resolution and Governing Law

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to its conflict of law provisions.

15.2 Jurisdiction

Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand.

15.3 Informal Resolution

Before initiating formal legal proceedings, we encourage you to contact us to seek informal resolution. Many disputes can be resolved through direct communication and good faith negotiation.

16. General Provisions

16.1 Entire Agreement

These Terms, together with your specific Rental Agreement, Privacy Policy, and Cookie Policy, constitute the entire agreement between you and Satori Homes regarding use of our services.

16.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative.

16.4 Assignment

You may not assign or transfer these Terms or your rental obligations without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

16.5 Notices

All notices under these Terms shall be in writing and delivered via email to the addresses provided during booking or to legal@satoriolesa for notices to us.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website with an updated "Last Updated" date. Material changes will be communicated via email to registered users. Your continued use of our services after changes indicates acceptance of the modified Terms.

For active bookings or rental agreements, the Terms in effect at the time of booking shall govern unless both parties agree to modified terms in writing.
